Antitrust Partner Antonio Bavasso, Counsel Josh Buckland and Associate Susanna Breslin authored the United Kingdom section of Global Competition Review’s (“GCR”) “Cases and Precedents: Cartels 2023,” an online publication that provides practical information on how competition law is enforced in multiple different jurisdictions. Antonio, Josh and Susanna analyzed 17 cases and found that, in recent years, the “landscape for UK cartel investigations has shifted significantly—with further changes on the horizon.” The authors noted that “cases with a public interest and/or consumer protection angle have been a clear enforcement priority,” and individual responsibility is of new importance as “directors found to have been involved in the infringement of competition law are increasingly likely to face disqualification proceedings” or even criminal proceedings. Looking forward, the authors expect that scrutiny into digital markets and algorithms is likely to expand; and the volume of parallel and multilateral proceedings as well as private enforcement are continuing to increase.
