Simpson Thacher Attorneys Author Law360 Article on FTC and DOJ Worker Antitrust Guidelines

Partners Abram Ellis, Karen Kazmerzak and Preston Miller authored an article titled, “5 Factors From Biden’s Final Worker Antitrust Guidelines,” which was published by Law360. The article discussed the recently published joint FTC and DOJ guidelines for business activities affecting workers, which laid out types of agreements that may violate antitrust laws. It further explored five sections of the worker guidelines and how the agencies may analyze business practices in those areas, including wage-fixing, no-poach agreements, exchanges of competitively sensitive information related to workers, employee non-compete agreements and other agreements that restrict workers’ freedom to leave their jobs.
