Partner Bill Russell authored an article titled, “Grant’s Pass v. Johnson: Supreme Court Decision Illustrates the Difficulties in Solving Homelessness,” which was published by the NYSBA Journal. The article discussed the U.S. Supreme Court decision in City of Grant’s Pass v. Johnson, which held that a municipality’s enforcement of an ordinance banning camping on public property against individuals experiencing homelessness does not violate those individuals’ constitutional rights. The article went on to outline the implications of this ruling for the state of New York, in addition to discussing how the decision may leave the door open for additional litigation over a state’s ability to prevent the unsheltered from living in public spaces.
