New York Court of Appeals Roundup: Beyond the Ballot – Voting Rights and the Law

In their column in the New York Law Journal, Litigation Partners Bill Russell and Linton Mann III analyzed the recent Court of Appeals decision in Fossella v. Adams. In the decision, a six judge majority struck down a New York City law permitting noncitizens to vote in local elections, finding that the New York State Constitution limits voting to citizens. The single dissenting judge would permit New York City to extend the ability to vote in local elections to noncitizens if the law is subsequently enacted through a referendum rather than City Council vote, but that is an unlikely scenario given the 6 to 1 nature of the majority’s opinion.
