In their column in the New York Law Journal, Litigation Partners Bill Russell and Linton Mann III discuss State of New York v. Vayu. In its decision, the Court reversed a divided Appellate Division, Third Department and held that a nondomiciliary’s actions in New York were sufficient to establish personal jurisdiction pursuant to New York’s long-arm statute. The Court determined that a Delaware corporation’s calls, emails and an in-person visit with the plaintiff in New York in order to establish a substantial ongoing business relationship were sufficiently purposeful activities to hold that the Delaware corporation subjected itself to personal jurisdiction in New York.
