Litigation Associates Karen Hunt and Lindsey Bohl co-authored an article published in the ABA Antitrust Law Joint Conduct Committee’s newsletter, Cartel and Joint Conduct Review. The article, titled “In Case You Missed It: FTC Commissioners Confirm Search Term Keyword Advertising Agreements Between Competitors Anticompetitive,” discusses the Federal Trade Commission’s affirmance of a previous Administrative Law Judge’s (“ALJ”) decision that search engine keyword bidding agreements between contact lens retailers suppressed competition in online search advertising for contact lenses. The decision has legal implications regarding keyword bidding agreements in various contexts and sheds light on the intersection of intellectual property and antitrust enforcement in the digital age.
