Partners David Blass, Meaghan Kelly, Michael Osnato and Rajib Chanda authored an article that was published by Harvard Law School Forum on Corporate Governance titled, “SEC Fines Two Investment Advisers for ‘AI Washing.’” The article discussed the SEC’s recent announcement of settled charges against two investment advisers for making false and misleading statement about their use of AI, which the SEC refers to as “AI washing.” The article further outlined takeaways for advisers when considering how statements are made around AI use and noted that the settled orders provide a good reminder to ensure that an adviser’s disclosures are consistent with policy and practice in the AI space as well as in other areas.
