Simpson Thacher Represents Amici Before 9th Circuit in Washington v. Trump

Simpson Thacher attorneys provided pro bono representation to several immigrant rights organizations filing an amicus brief in Washington v. Trump, No. 17-35105 (9th Cir. 2017). In this appeal, the States of Washington and Minnesota seek to keep in place a nationwide temporary restraining order that prevents enforcement of President Trump’s Executive Order banning immigration from several Muslim-majority countries. In support of the States’ efforts, the American Immigration Council, National Immigration Project of the National Lawyers Guild, Northwest Immigrant Rights Project, Human Rights First, Kids In Need Of Defense and the Tahirih Justice Center filed an amicus brief arguing that (1) the temporary restraining order was not appealable, (2) the judiciary must act as a check on Presidential actions, and (3) the Executive Order causes irreparable harm to numerous individuals and organizations. Given how quickly this litigation is moving, the brief was drafted and filed in little more than a day. The case was decided on February 9th in favor of keeping the restraining order in place, thus barring the Executive Order.
