STB Wins $45 Million Patent Infringement Jury Verdict for 3Com

On April 9, 2008, following a two week jury trial before Chief Judge Vaughn Walker in the U.S. District Court in San Francisco, STB won a unanimous verdict for our client 3Com Corporation of Marlborough, Mass., finding that Realtek Semiconductor Corporation of Taiwan willfully infringed each of the asserted claims of four separate 3Com patents. The patents cover key 3Com technology in the field of network interface adapters, which are devices for connecting computers to networks. After finding that all of the patents are valid and that Realtek induced infringement of them by its US customers, the jury awarded 3Com $45.3 million dollars for past damages. The damage award does not include pre-judgment interest (dating back to 1997), any provision for future damages during the remaining years of life of the patents, or the "enhanced" damages that 3Com will seek based upon the jury's finding of willfulness.
Hank Gutman presented the case as lead trial counsel. The trial team consisted of Kerry Konrad, Victor Cole, Brian McCloskey, Amanda Motsinger, Phillip Sternhell and Greg Chuebon from the New York office.
