Matthew Penny and Bryce Friedman authored an article titled, “Pollution Exclusions and PFAS Claims: Reading Tea Leaves From Early Coverage Rulings in New York and Elsewhere,” which was published by New York Law Journal. The article discussed how a multitude of lawsuits alleging harms purportedly caused by “PFAS” chemicals have resulted in billions of dollars in settlements, which, in turn, have led to demands for insurance coverage and associated coverage litigation. The article further explored some early court decisions on PFAS-related coverage issues and how they illustrate certain key factors that may drive the resolution of future disputes over the application of pollution exclusions to PFAS claims.
