New York Court of Appeals Roundup: Conviction of Criminal Defendant Reversed Because of Four Year Delay in Filing Indictment

In their New York Law Journal column, Litigation Partners Bill Russell and Linton Mann III discuss People v. Regan. In the 4-2 decision written by then-Associate Judge and now Chief Judge Rowan D. Wilson, the Court of Appeals reversed the conviction of a criminal defendant in light of the largely unexplained four-year delay in filing an indictment. The decision subsequently attracted attention as it was raised by opponents to Judge Wilson’s elevation to Chief Judge in his nomination hearings.
