Chet Kronenberg and Jacob Waschak Author Daily Journal Article on Dismissing PAGA Lawsuits when Plaintiff Isn’t Competent

Litigation Partner Chet Kronenberg and Associate Jacob Waschak authored an article in Daily Journal titled, “Courts should dismiss PAGA suits when plaintiff isn’t competent.” The article explores whether a court has discretion to dismiss a Private Attorneys General Act (“PAGA”) lawsuit when the plaintiff is not competent, similar to how, in a class action, a court has discretion to refuse to certify a class when the named plaintiff is inadequate. The article highlights that it is time for a California appellate court to address the issue of whether an incompetent PAGA plaintiff can pursue a representative action on behalf of the state of California.
