Partner Michael Osnato, Senior Counsel Allison Bernbach and Associate William LeBas authored an article titled, “Key Takeaways From Recent SEC Cybersecurity Charges” which was published by the Harvard Law School Forum on Corporate Governance. The article explores the SEC’s three recently announced settlements with eight registered investment advisers and broker-dealers for violations of Rule 30(a) of Regulation S-P and, in the case of one of the firms charged, for violations of Section 206(4) and Rule 206(4)-7 of the Advisers Act. It further explains how these settlements reflect the Enforcement Division’s continued focus on cybersecurity and highlights that advisers and broker-dealers should ensure that they are regularly reviewing and testing their cybersecurity policies and procedures.
