Partners Michael Osnato, Michael Wolitzer, Meaghan Kelly and David Blass, Senior Counsel Allison Bernbach and Counsel Carolyn Houston authored an article titled, “ESG Scrutiny From the SEC’s Division of Examinations,” which was published by the Harvard Law School Forum on Corporate Governance. The article analyzes the SEC’s heightened scrutiny of ESG (environmental, social and governance) and SRI (socially responsible investing) under the Biden Administration, and how it is anticipated that those areas will become priorities for the Division of Examinations. It further discusses ways this increased focus has manifested, including through proposed legislation and targeted reviews of ESG practices, and how the rise of ESG scrutiny in the U.S. mirrors recent developments in Europe.
