New York Court of Appeals Roundup: Court Reverses Sentence Improperly Based on Unrelated Action

In their column in the New York Law Journal, Litigation Partners Bill Russell and Lynn Neuner discuss the recent four-to-three decision in which a narrow majority of the Court of Appeals reversed a trial court’s sentencing determination based on information that had been unsealed from the record in an unrelated criminal action in which the same defendant had been acquitted of all charges.
