California Lawyers Association Publishes Simpson Thacher Antitrust Article

Litigation Partner Buzz Frahn and Litigation Associate Alexander Moser co-wrote an article published on the California Lawyers Association’s website. The article, “Northern District of California Issues Foreign Anti-Suit Injunction in Battle Over Propriety of Injunctions for Infringement of Standard Essential Patents,” discusses the April 2018 decision in Huawei Techs., Co. v. Samsung Elecs. Co. Judge William H. Orrick issued a foreign anti-suit injunction blocking Huawei from enforcing an injunction issued by the Intermediate People’s Court of Shenzhen that would have forced Samsung to shut down many of its operations in China. The Shenzhen Court found Samsung infringed two of Huawei’s patents and enjoined Samsung’s Chinese affiliates from manufacturing or selling 4G LTE smartphones in China. Judge Orrick sided with Samsung, issuing the anti-suit injunction to ensure settlement pressure did not prevent him from evaluating the propriety of injunctive relief for the parties’ standard essential patents.
