This Alert discusses recent decisions relating to the stacking of insurance policies, the appropriate trigger for determining coverage under general liability and first-party property policies, and interpretation of the phrase “direct physical loss.” In addition, we discuss rulings addressing insurance coverage for claims seeking restitution and for emotional distress, and an insurer’s right to seek reimbursement of settlement payments from a policyholder. Finally, we report on rulings relating to the interpretation of reinsurance certificates, the assignability of statutory bad faith claims, and the scope of the common-interest doctrine.
