This Alert discusses recent decisions relating to a policyholder’s failure to comply with a voluntary payment provision. In addition, we report on rulings addressing excess insurance coverage, the availability of general liability coverage for computer data breaches and whether an attorney-client relationship exists between a policyholder’s defense counsel and the insurer funding the defense. Finally, we discuss a United States Supreme Court decision finding that there is no federal court jurisdiction under CAFA for a suit brought by a state attorney general.
