Microsoft v. AT&T: Limiting the Extraterritorial Reach of U.S. Patent Law

06.05.07
This memo addresses the U.S. Supreme Court's decision in Microsoft Corp. v. AT&T Corp. There the Court continued the recent trend of reining in the patent law system. The Court held that to be liable under Section 271(f), a U.S. infringer must manufacture and ship tangible components from the United States that are later incorporated into an infringing device. This memorandum addresses the decision and its implications in detail.
