Antitrust Partner Antonio Bavasso, Counsel Josh Buckland and Associate Michael Tagliavini authored an article that was published by Competition Policy International (CPI) titled, “Highest EU Court Reinforces Merger Control in Telco Sector and Beyond.” The article discussed the European Court of Justice’s (“ECJ”) recent highly-anticipated ruling, which confirmed “more likely than not” as the appropriate standard of proof for determining whether a merger would significantly impede effective competition and clarified the concept of “important competitive force.” The piece also discussed the major implications of the ruling, noting that it would likely lead to more vigorous enforcement of merger control policy in the EU both within and beyond the telco industry.
