John Terzaken and Sara Razi, Global Co-Chairs of the Firm’s Antitrust and Trade Regulation Practice, were quoted in an article titled, “FTC, DOJ End 2023 With New Guidance, Lingering Challenges,” which was published by Law360. The article discussed the FTC and DOJ’s competition enforcement activity throughout 2023, highlighting their mixed merger enforcement track record and the lingering challenges the agencies face headed into 2024. John explained that the DOJ’s labor-side antitrust prosecutions have gotten companies to treat their approach to worker mobility and wages with great care, noting, “Certainly, the regulated community has gotten the message.” Looking ahead however, he highlighted that concern over enforcement actions will not last if the DOJ can’t improve its enforcement track record, explaining that caution “will eventually wear off if people aren’t afraid of the person on the other side of the table.” Sara further discussed the impact that the agencies’ enforcement actions have had on merger deterrence. "Some deals are not moving forward because of the enhanced risk of a merger challenge," she said.
