Ninth Circuit Affirms Simpson Thacher Win for AmGUARD Insurance Company

On December 12, 2022, the Ninth Circuit affirmed United States District Judge R. Gary Klausner’s order dismissing nine business’ claims for insurance coverage from AmGUARD Insurance Company. The Ninth Circuit found the insurance contracts’ virus exclusion precluded insurance coverage for all COVID-19 pandemic-related losses.
