11.12.21

Corporate Partner David Blass was quoted extensively in an article published by Hedge Fund Law Report titled, “Exams of Non‑U.S. Advisers: The SEC’s Authority and Trends (Part One of Three).” The article, part one of a three-part series, analyzed the SEC’s authority to conduct examinations of non‑U.S. registered investment advisers and exempt reporting advisers as well as the recent trend of a higher number of exams of those advisers. David said that, “The remote work environment promotes a greater ability of the SEC to examine non‑U.S. advisers because of the reduction of travel costs. I do think the numbers [of those exams] are going up, and the SEC’s interest in examining those advisers is pretty high.” He further explained that those factors combined with the SEC’s initiatives aimed at conducting get-to-know-you exams of newly registered advisers and exams of those that have never been examined before have enabled the SEC to have a higher touch point with non‑U.S. advisers than in previous years.
