Restructuring Partners Adam Gallagher and James Watson were quoted in a Law360 article titled, “Experts Predict Jump In Insolvencies As Gov’t Measures Ease,” which analyzed the Q3 insolvency market according to statistics issued by the U.K. government. Adam noted how, while still low in the third quarter, restructuring plans for large companies may start to increase after the government removes the protective shield early next year. He further explained however that, “protection by the state against companies failing or being restructured stifles innovation. You need to have circulation of capital, corporations and ideas in order to have a vibrant economy.”

James mentioned that the government has rightly given businesses breathing room during the pandemic but it is now fair for market forces to take over again. “The protections are being tapered, which is probably the right approach given all the public money that has been used to support COVID-affected business and jobs. Then it’s right and proper that businesses should stand or fall according to the new normal.”
