Corporate Partner Olga Gutman was quoted extensively in a Private Equity Law Report article titled, “Prioritizing Upper‑Tier Structures: Pitfalls to Avoid and the Value of Restrictive Covenants When Managing Personnel (Part Two of Two).” The commentary stemmed from a panel discussion she participated in as part of Practising Law Institute’s recent Advanced Issues in Private Funds 2021 program, and analyzed restrictive covenants for managing employees as well as related considerations for firms looking to update their internal arrangements. When discussing restrictive covenants, Olga explained that they can sometimes be strong deterrents and that a new team launching a new firm with sufficient market demand may choose not to include potential investors in non-solicitation provisions because there has been a lot of press about firms setting an example by enforcing restrictive covenants.
