Rajib Chanda Quoted in BoardIQ on Potential for Mutual Funds to Invest Directly in Cryptocurrency

Corporate Partner Rajib Chanda was quoted in an article in BoardIQ, a Financial Times publication, titled, “Gensler’s SEC Expected to Lay Out Crypto Guidelines.” The article analyzed the possibility that Gary Gensler, the nominee for Securities and Exchange Commission chair, may create a regulatory framework for mutual funds to invest directly in cryptocurrency in the future. Rajib noted that custody is the biggest issue a regulatory framework would need to address. He said, “one of the major parts of the ’40 Act is how do you make sure something that exists fully anonymously is fully safeguarded in your name. The SEC cares about that. Sponsors obviously care about that because they don’t want to lose their assets. And boards should care about that. Boards should be satisfied that their exposure to bitcoin is not illusory because it can be stolen by someone who has the key.”
