Counsel Chris Sprigman was interviewed by National Public Radio’s (NPR) “All Things Considered” program. The segment focused on a recent lawsuit filed by Chooseco, the publishing company for the Choose Your Own Adventure book series, against Netflix. Chooseco is accusing Netflix of infringing on the “Choose Your Own Adventure” trademark in a recent interactive episode of their series Black Mirror. Chris notes that “it makes perfect sense from Chooseco’s perspective to try to wring whatever value remains out of this trademark.” However, the legal determination that a trademark has become generic is usually decided through lawsuits similar to this.
“They’re playing with fire because it’s entirely possible that Chooseco files a lawsuit and they end up with a finding that the trademark has become generic,” Chris adds.
