Simpson Thacher Defeats Class Certification in Antitrust Action Against HCA

On January 23, the District Court for the Western District of Texas denied Plaintiffs’ motion for class certification in an antitrust suit regarding wages paid to hospital nurses.  Simpson Thacher clients HCA Inc. and Methodist Healthcare System of San Antonio are among the San Antonio-area hospital defendants in the case. The Court also granted, in part, the Defendant’s motion to exclude the Plaintiffs’ expert economist’s report in support of the motion for class certification.

In denying the Plaintiffs’ motion for class certification, the Court held that the Plaintiffs failed to satisfy the predominance requirement of Rule 23(b)(3). Specifically, the Court found that the Plaintiffs failed to provide any causal link between the alleged misconduct and the alleged injury to the plaintiffs.
