Simpson Thacher Wins Employment Discrimination Suit for City of New York, NYPD and Individual Police Officers

On March 30, 2018, the Firm successfully defended the City of New York, NYPD and individual police officers, on a pro bono basis, in an employment discrimination suit. The Plaintiff, a former police officer terminated for misconduct, filed the suit in 2012 in the Eastern District of New York, asserting federal and state law claims for discrimination, retaliation and hostile work environment on the basis of his race, religion, national origin and alleged disability.
Judge LaShann DeArcy Hall granted the defendants’ motion for summary judgment, and dismissed all remaining claims, holding that collateral estoppel barred the discrimination, retaliation and hostile work environment claims made by the plaintiff, because plaintiff had appealed his termination through an administrative trial and Article 78 proceeding in state court, which found similar discrimination and retaliation claims by the plaintiff to be meritless.
