Sara Razi Quoted in Global Competition Review on Merger Enforcement Under New U.S. Administration

Litigation Partner Sara Razi was quoted in Global Competition Review in a June 16, 2017 article titled, “Companies Kick the Tyres on Deals, But Lawyers Wait and See.” The article discusses how M&A deals that many companies did not believe could receive antitrust approval under the Obama Administration might be possible under the new administration. Sara, a former senior official at the Federal Trade Commission, told the publication that enforcement efforts during the Obama administration resulted in a great deal of important case law on market definition and efficiencies, in particular. For example, federal courts repeatedly rejected the argument that claimed efficiencies offset any potential harm, she said. Sara also stated that while there may be certain upcoming enforcement changes on the margins – such as close-call cases involving proposed remedies - there is unlikely to be a sea change that some anticipate.
