On May 11, 2017, the United States District Court for the Central District of California dismissed a claim under the Private Attorneys General Act of 2004 (“PAGA”) against Vivint, Inc. with prejudice. Under PAGA, an employee, who stands in the shoes of the California Labor Commissioner, can sue on behalf of him or herself and other employees. Judge Wilson held that the First Amended Complaint was “devoid of any factual allegations supporting [the plaintiff’s] claims that Vivint violated the Labor Code rights of other field professionals.” The Simpson Thacher team on this case is Chet Kronenberg, Josh Neiman and Ben Harris.
