Simpson Thacher Again Obtains Dismissal of Securities Class Action Against Yingli Green Energy Holding Company Limited

On March 15, 2017, the United States District Court for the Central District of California, in a 31-page decision, dismissed a putative class action lawsuit for securities fraud against Yingli Green Energy Holding Company Limited. Judge Wright held that the plaintiffs failed to adequately plead a material misrepresentation or scienter. The decision dismissed a number of claims without leave to amend, noting that the plaintiffs had failed to remedy deficiencies already identified by Judge Wright in dismissing the plaintiffs’ prior complaint.
