Simpson Thacher Wins Jury Verdict in IOENGINE Patent Case

On January 13, 2017, after a five-day trial in the District of Delaware before Judge Gregory M. Sleet, the jury returned a verdict in favor of the Firm’s client, IOENGINE, LLC (“IOENGINE”), on its claims of patent infringement. The case involved secure USB storage devices sold by Interactive Media Corp. d/b/a Kanguru Solutions (“IMC”) under the “Defender” brand. The jury found all the asserted claims of IOENGINE’s patent both valid and infringed by the Defender products, and awarded the full extent of damages sought by IOENGINE for past infringement. The jury rejected all of IMC’s challenges to the patent and credited IOENGINE’s founder as the sole inventor of the patented technology.
The IMC case is now in the post-verdict phase, and IOENGINE will seek ongoing royalties for sales of Defender products. A trial against a second defendant, Imation Corp., is set to begin on February 13, 2017.
