On May 5, 2016, the United States Court of Appeals for the Ninth Circuit issued a unanimous decision affirming the dismissal with prejudice of a whistleblower False Claims Act lawsuit against Deutsche Bank. The complaint alleged that certain banks and other financial institutions defrauded the federal government of $137 billion in connection with the government intervention in equity markets in late 2008. The action asserted that false claims were made to the federal government to secure financial assistance during the financial crisis.
The Simpson Thacher team included Bryce L. Friedman and Colin Rolfs.
