Simpson Thacher Files Amicus Brief with the New York Appellate Division, First Department Regarding Application of the New York Family Court Act

Simpson Thacher filed a brief amici curiae in the New York Appellate Division, First Department on behalf of 15 organizations in connection with the appeal of a Family Court decision that applied the New York Family Court Act to a fetus in a child neglect case. The Firm’s brief argued that application of the New York Family Court Act to fetuses was inconsistent with the language of the statute and would pose great harm to the health and constitutional rights of pregnant women. On April 21, the First Department dismissed the appeal as moot, but vacated the family court’s decision so that it could not be cited as precedent. The case is In re Maddock E., Case No. NN-32643/13.
