On January 21, Simpson Thacher co-hosted the 2016 Shareholder Activism Conference with the Columbia Law School Center on Corporate Governance. Corporate Partners Alan Klein, Lee Meyerson and Eric Swedenburg each served as moderators for the three panel discussions. The first panel, “Institutional Investors and Activism,” included leading experts from institutional investors and activist hedge funds. The second panel, “A Conversation with the Chief Justice: Recent Delaware Developments Affecting Shareholder Activism,” featured Chief Justice Leo Strine of the Delaware Supreme Court discussing recent Delaware case law and its potential impact on shareholder activism. The final panel, “Responding to Activists: Examining Trends and Tactics,” comprised panelists from financial, communications and governance advisors discussing the emerging trends and tactics that are used by companies in responding to activists. Columbia Law School Professors John Coffee, Jeffrey Gordon, Robert Jackson and Eric Talley also participated as moderators.
