Simpson Thacher Wins Reinstatement of Case in Massachusetts Appeals Court

On April 29, 2015, Simpson Thacher won a unanimous decision in the Massachusetts Appeals Court, reversing the Superior Court and reinstating National Indemnity Company and Resolute Management Inc.’s lawsuit against Transatlantic Reinsurance Company and its owner Alleghany Corp. The Firm filed suit in 2013, alleging that after a bidding war for Transatlantic, Alleghany and Transatlantic tortiously interfered with National Indemnity and Resolute’s business in a manner that violates the Massachusetts unfair trade practice statute known as Chapter 93A.
The Appeals Court addressed the standard to state a claim for violation of the unfair trade practice statute, an issue on which it had not previously ruled. In doing so, the Court concluded that National Indemnity Company and Resolute Management had stated a cognizable claim for relief and allowed the case to proceed. The Firm’s clients will now have the opportunity to prove at trial that they are protected by Massachusetts law in this case.
