Simpson Thacher Wins Summary Judgment in Confidential Reinsurance Arbitration

This week, Simpson Thacher won summary judgment in a confidential reinsurance arbitration for its client Equitas (which manages liabilities of the respondents, Certain Underwriters at Lloyd’s of London). Summary judgment briefing was conducted over the summer, and oral argument was held in August. At the request of the arbitrator, a retired federal judge, the parties submitted supplemental briefing and expert affidavits this fall. On Wednesday, the arbitrator granted summary judgment to Certain Underwriters and dismissed all claims by the adversary, rejecting our opposing counsel’s demand for an evidentiary hearing.
