In 2012, Convergys Corporation was sued in a class action alleging it had violated the Telephone Consumer Protection Act (TCPA) by making unauthorized calls to individuals' cell phones. Convergys sought insurance coverage for the TCPA class action from certain underwriting syndicates at Lloyd's London known as Beazley. On March 25, 2014, Judge Claire R. Kelly (sitting by designation in the Southern District of New York) granted Beazley's motion for summary judgment declaring that Beazley is not obligated to indemnify Convergys. Bryce Friedman argued the motion and the Simpson Thacher team includes Mary Kay Vyskocil and Joshua Polster.
