Sixth Summary Judgment Ruling for Travelers

On March 13, the Honorable Katherine B. Forrest of the U.S. District Court for the Southern District of New York awarded summary judgment to Travelers in a dispute concerning Northrop Grumman’s claims for coverage for environmental clean-up costs.  This is the sixth summary judgment motion granted in Travelers’ favor in the proceeding.  The ruling found that Travelers is not obligated to provide coverage for any Northrop Grumman liabilities to three water districts that may be impacted by contamination migrating from Northrop Grumman’s Bethpage, Long Island facility due to Northrop Grumman’s failure to provide timely notice of claims, pollution exclusions in the Travelers policies, and Northrop Grumman’s agreement to pay for remediation without Travelers’ consent.  The Simpson Thacher team representing Travelers includes Mary Beth Forshaw, Lynn Neuner, Meghan Cannella, Rae Adams, Christopher Hultman, Rita Maxwell, Medora Akers, Robert Arnay and Katelyn Benton.
