Simpson Thacher Wins Multiple Summary Judgments for Travelers

During the week of February 24, the Honorable Katherine B. Forrest of the U.S. District Court for the Southern District of New York granted two summary judgment motions the Firm filed on behalf of Travelers in a dispute concerning Northrop Grumman’s claims for coverage for environmental clean-up costs at Northrop Grumman’s Bethpage Facility and the adjacent Bethpage Community Park. The first ruling found that Travelers has no obligation to provide coverage for liabilities arising from the Bethpage Facility because Northrop Grumman failed to provide timely notice, Northrop Grumman made voluntary payments without Travelers’ consent, and pollution exclusions within the policies bar coverage. The second ruling found that Travelers has no obligation to provide coverage for liabilities arising from the Bethpage Community Park because Northrop Grumman failed to provide timely notice, pollution exclusions within the policies bar coverage, and the New York statute of limitations bars recovery for one of the claims.
