Simpson Thacher Wins Summary Judgment in Insurance Bad Faith Lawsuit

On December 27, 2013, Judge Gloria M. Navarro of the United States District Court for the District of Nevada issued an order finding that the Firm’s client, National Fire & Marine Insurance Company, was entitled to summary judgment in connection with National Fire’s dispute with its policyholder, Sharp Plumbing, Inc. Sharp Plumbing had filed a complaint against National Fire alleging bad faith in connection with National Fire’s defense and indemnity of Sharp Plumbing in the underlying Kitec plumbing class action litigation. National Fire counterclaimed against Sharp for a declaration that National Fire had no indemnity obligation to Sharp and for reimbursement of the settlement payment National Fire had made on Sharp Plumbing’s behalf subject to a complete reservation of rights. In granting summary judgment for National Fire, and denying Sharp Plumbing’s motion for summary judgment, Judge Navarro concluded that National Fire had no duty to indemnify Sharp or pay the settlement, and ordered Sharp Plumbing to reimburse National Fire. Judgment was entered on December 30, 2013.
