Simpson Thacher Obtains Second Circuit Affirmance of Dismissal of ERISA Putative Class Action

On May 8, 2012, the Second Circuit affirmed the Southern District of New York’s decision granting defendants’ motion for judgment on the pleadings brought on behalf of a putative class of participants in a 401k plan sponsored by J.P. Morgan Chase & Co. (“JPMorgan Chase”) and Chase Manhattan Bank.  The case arose out of the 2001 collapse of Enron.  Simpson Thacher represented all of the defendants. The team consisted of Thomas C. Rice, Jonathan K. Youngwood (who argued the appeal), Janet A. Gochman and Hiral D. Mehta.
