Simpson Thacher Client Wins Summary Judgment In False Claims Act “Whistleblower” Case

In a 68-page order dated January 24, 2011, Chief United States District Judge Vance of the Eastern District of Louisiana granted summary judgment to Firm client The Standard Fire Insurance Company dismissing a qui tam action under the False Claims Act. A purported “whistleblower” alleged that certain insurers and others defrauded the United States by making false claims to the National Flood Insurance Program after Hurricane Katrina. Agreeing with arguments advanced by the Firm, the Court applied the False Claim Act’s public disclosure bar to dismiss all claims against Standard Fire. The case is United States ex rel. Branch Consultants, LLC v. Allstate Insurance Co., et al., No. 06-4091 (E.D. La.).
