Simpson Thacher Obtains Dismissal of Complaint Against Pro Bono Client, The Partnership for the Homeless

On August 20, 2010, the Honorable Janice A. Taylor of New York Supreme Court, Queens County, dismissed a complaint brought by the owner of two buildings alleging that the Partnership for the Homeless (PFTH), a nonprofit organization that assists low-income individuals to secure housing, breached a contract requiring PFTH to make certain rental payments and security deposits on behalf of four of its clients. The Court dismissed the complaint based on improper service, but noted in its written decision that even with proper service, the Court would have dismissed the complaint for plaintiff's failure to allege that the PFTH had an obligation to pay the disputed amounts.
