Simpson Thacher litigation partner Jonathan K. Youngwood will co-chair, and litigation partner Mark J. Stein will speak at Practicing Law Institute’s "Securities Litigation & Enforcement Institute 2010" program on September 21, 2010 in New York.
Mr. Youngwood will moderate a panel on "Corporate Governance Litigation," discussing an overview of recent Delaware and other key state decisions, developments in merger litigation and the evolving business judgment rule. In addition, he will moderate a panel on "Case Management and Settlement Issues in Securities Litigation," addressing issues including filing and settlement trends, mediation techniques, use of experts and D&O liability issues. He will also moderate Part I of a panel entitled, "Government Initiatives and Perspectives/How to Deal Effectively With the Government," addressing issues including SEC and DOJ trends in the Obama Administration, financial crisis cases, recent insider trading cases and actions against lawyers, accountants and other gatekeepers.
Mr. Stein will speak on Part II of the panel entitled "Government Initiatives and Perspectives/How to Deal Effectively With the Government," addressing practices and strategies for internal investigations, preserving privilege and work product, criminal investigation and prosecution of securities fraud, defense perspectives on recent SEC and DOJ actions, managing multi-prong proceedings involving the government and private litigants.
