Simpson Thacher partner Robert Smit was interviewed by Latin Lawyer for an article published on May 26, 2010 titled “Aguas Argentinas creditors withdraw US complaint.” Smit spoke in connection with the Firm’s successful litigation achievement for our client Agua y Saneamientos Argentinos S.A. (AySA) in which the Plaintiff, the Aguas Argentinas creditors, withdrew its Complaint and discontinued the action against our client.
In commenting on the litigation outcome, Smit says “This is quite unusual, and we believe it reflects both the compelling record created in the litigation, as well as the reality – that AySA and Aguas Argentinas are separate and independent companies such that AySA cannot reasonably be held liable for Aguas Argentinas’ debts.’”
