Simpson Thacher recently represented a group of nonprofit legal service organizations across the country in a collective effort to ensure due process for immigrant detainees with mental health issues. The team drafted a letter on behalf of the legal services organizations to U.S. Attorney General Eric Holder, recommending protections for all persons in removal proceedings who have mental disabilities, including the appointment of counsel to anyone in deportation proceedings with a mental disability, and the appointment of guardians ad litem to speak on behalf of those found mentally incompetent. On September 10, the issue of deportation hearings for individuals with mental disabilities was highlighted in The New York Times along with a link to the letter.
