Simpson Thacher recently prevailed in a domain name arbitration in front of the World Intellectual Property Organization on behalf of the New York City-based not-for-profit corporation New York Cares, Inc. Simpson Thacher filed a complaint with WIPO, because an anonymous "cybersquatter" had registered the domain names newyorkcares.org and newyorkcares.com and was using them in connection with unauthorized websites. The cybersquatter ignored numerous protests from New York Cares and Simpson Thacher regarding such activities, which infringed New York Cares' federally registered trademark. After Simpson Thacher brought the WIPO proceeding, the domain name registrar agreed to transfer both domain names from the cybersquatter to New York Cares.
Lori E. Lesser, Brian P. McCloskey and Genevieve Dorment represented New York Cares in the WIPO proceeding. Gail Harris, a Retired Partner who is currently Of Counsel to the Firm, is President of the Board of Directors of New York Cares, New York City’s leading volunteer organization. Last year, New York Cares’ 43,000 volunteers helped 450,000 New Yorkers in need.
