Firm Wins DC Court of Appeals Affirmance Dismissing Action Against Heineken and Other Alcohol Beverage Companies

06.28.07

On June 26, 2007, the District of Columbia Court of Appeals affirmed in its entirety the D.C. Superior Court's order dismissing with prejudice a class action complaint alleging that our client, Heineken, and other alcohol beverage companies purportedly "targeted" underage youth with mass media alcohol advertising. The Simpson Thacher team prepared the successful briefs on behalf of the industry in the trial court and on appeal. Five trial courts in other jurisdictions have dismissed similar class actions brought against Heineken and other alcohol beverage companies; this is the first appellate ruling. The Simpson Thacher team consists of David Ichel, Mark Cunha, Bryce Friedman, Helena Almeida, Marissa Piropato, Tamala Boyd, Michael Shenkman, summer associate David Edwards and paralegals Rick Rosario, and Robert Paster.
